D r Vivien Chen is Senior Lecturer at Monash University. She teaches corpo rate governance and social responsibility to postgraduate students\, and researches Malaysian and Australian corporations law. Her publications include ‘\;Corporate Law and Political Economy in a KleptocracyR 17\; in the American Journal of Comparative Law and ‘\;Gen der Diversity on Corporate Boards: A Law and Social Movements Perspectiv e’\; (co-authored) in the Journal of Law and Society. Buy Now Pay Later has been laude d as among the latest trends in smart ‘\;ways to pay’\;\, ridi ng on the wave of digital disruption that has gained traction internatio nally. At the same time\, concerns have been raised over harm to vulnera ble consumers mired in unanticipated debt. This research facilitates a d eeper understanding of the phenomenon from a bottom-up perspective throu gh a survey of 400 Malaysian consumers\, focus groups\, and an interview with the Consumer Association of Penang. The article explores how digit alisation\, payment by instalments and providers’\; advertising str ategies can collectively mask the risks for unsuspecting consumers. Insi ghts from the analysis are used to inform proposals to strengthen the em erging Malaysian regulatory framework.
Malaysia is the first count ry in ASEAN to introduce consumer credit legislation. This has the poten tial to inform the development of regulatory frameworks in other ASEAN M ember States. Yet as a pioneer in consumer credit regulation in the regi on\, there are real risks that transplantion of laws developed for Weste rn industrialised countries\, without consideration of the contextual di fferences\, may result in unintended consequences. Closer examination of their respective contexts suggests that there are fundamental dispariti es that are likely to exacerbate the harm that the poorest Malaysians fa ce. The findings highlight the urgent need to address the underlying pro blem of poverty to avoid unintended consequences. The research further c onsiders the regulatory architecture that can enhance or impede the effe ctiveness of the reforms.

leary Gottlieb Law Prize. \;Dan’\;s research has been profiled

Professor Roza Nurgozhayeva
Roza Nurgozha
yeva is an Assistant Professor of Law at Nazarbayev University\, Kazakhs
tan. From 2018 to 2020\, Roza held the position of a post-doctoral fello
w at the Center for Asian Legal Studies\, the National University of Sin
gapore Faculty of Law. She holds a Doctor of the Science of Law (J.S.D.)
degree from Cornell University. Dr. Nurgozhayeva is a member of the Ame
rican Society of International Law. Her research interests include compa
rative law\, corporate governance\, corporate law\, state-owned enterpri
ses\, and sustainable development. She presented her research at leading

arative perspective. She is a Research Member of the European Corporate
